      Cooleemee, NC..a copy of James Montgomery's Will..April 1838 (originally
      written 1834) Cooleemee Presbyterian Church is located 20 miles west of
      Lexington..Iredell County:
      "In the name of God, amen
      I, James Montgomery of the county of Caswell and the state of North Carolina
      being weak of body but sound of mind and disposing memory, calling unto mind
      that it is appointed unto all men once to die-do make and ordain this my last
      will and testament.
      First-I commit my soul to the Almighty God that gave it and my body to be
      buried in a decent christian manner at the descretion of my executor, nothing
      doubting but at the general resurrection I shall receive the same again by the
      mighty power of God; and as touching such wordly estate wherein it hath pleased
      God; to bless in this world I give and demise and dispose of the same in
      the following manner and form viz.
      1st To my wife Rebekah negro named Jack, a negro boy named Pete, a negro
      woman named Rhoda, the tract of land on which I now live or as much thereof as
      she wants, such part of my household and kitchen furniture, stock and
      plantation tools as she may choose, all of which she is to hold during her life
      time - and at her death to be equally divided amongst my legatees except such
      parts as are herein afterward disposed of.
      2nd To my son Abraham my tract of land in Iredell County containing 200 acres
      to be held by him during his life time - and after his death to be sold and the
      proceeds to be divided equally amongst his children - his widow (should he
      leave one) her dower in it during her life time.
      3rd To the Foreign Missionary Society and the American Tract Society fifty
      dollars to be equally divided between them.
      4th To my son James my bed and furniture after the death of my wife.
      5th It is my will and desire that all the residue of my estate real and
      personal be equally divided amongst my children upon the following conditions
      however viz: that my daughter Jane's part be sold upon best terms and the
      amount arising therefrom to be loaned out upon security the interest of which
      to be paid over to her, or applied to her benefit exclusively during her life
      time, and at her death the principle and interest too (if there is any) to be
      equally divided amongst the children. And also that my daughter Rebekah's part
      to be held by her during her life time and at her death (should she leave no
      heirs born of her body) to be equally divided amonst my other legatees-
      6th Upon the death of my wife my son Edward is to have the negro woman Rhoda
      and the boy Peter upon the following conditions viz: that he pay to the other
      legatees half the value of Rhoda and the whole value of Peter - deducting
      therefrom of course the amount of his share in said negroes which share he is
      not to pay for and the said negroes to be valued at the time he received them.
      7th Should my daughter Rebekah desire to keep the boy Jerry which I have
      heretofore lent her she is at liberty to take him at the valuation and upon the
      terms mentioned in the 5th item or article respecting her share."
      James was one of the founders of Caswell Academy, a college preparatory school
      for boys. He left money in his will to the Foreign Missionary Society and the
      American Tract Society.
