A suit to break Alexander Montgomery 1840 will was filed by the Willsons. There had been several breaks in the family previous to his death in 1841 but he left some possessions and money to his daughters with the bulk of his real estate to youngest son, Richard. In all he left 600 acres in York Twp. Alexander III, Richard's older brother who had married sister of Stillwell Willson was also party to the suit. He and his father had been estranged for several years prior to the older Alex's death in 1841. John, the eldest son was in exile in Rochester, N.Y. until he was pardoned in 1846-47 when he then was able to return to Toronto. Richard, at the time of his father's death was about 34 years old, married and father of his first six children, ranging in age from Rebecca Jane who was 9 down to baby Martha born in 1841. It is likely that father Alexander felt Richard need all the help he could get to raise a family so large even at the start. Later he had eight more children.
